These Terms and Conditions (the “Terms”) govern your use of ecosmartsecurity.com (the “Website”) and purchases made from EcoSmart Security (“EcoSmart Security,” “we,” “us,” or “our”). By using the Website, creating an account, or submitting an order, you agree to these Terms and the policies referenced here. If you do not agree, do not use the Website or place an order.
1. Eligibility and Authority
You must be at least 18 years old, or the age of legal majority where you live, to place an order. If you purchase on behalf of a company, property owner, or other organization, you represent that you have authority to bind that organization to these Terms.
2. Products and Scope of Online Orders
EcoSmart Security sells security, surveillance, access-control, life-safety, and smart-home equipment for residential and commercial use. Unless a product page or checkout summary expressly says otherwise, an online equipment purchase does not include professional installation, alarm monitoring, cloud storage, cellular service, permits, programming, or a recurring service plan.
Installation, monitoring, subscriptions, financing, and other services may require separate eligibility requirements, charges, and signed agreements. If a separate written agreement conflicts with these Terms, that agreement controls for the services it covers.
3. Product Information and Compatibility
We work to keep product descriptions, specifications, images, availability, and compatibility information accurate. Manufacturers may revise products, packaging, firmware, apps, or specifications without notice, and colors or minor appearance details may vary by screen or production run.
Security products are often model-, protocol-, region-, account-, panel-, recorder-, network-, or service-provider-specific. Before ordering, review the model number, power requirements, communication protocol, supported platform, installation requirements, and any subscription or account requirements. Contact us when you need help confirming compatibility. A general product description is not a guarantee that an item will work with every existing system.
4. Orders and Acceptance
Your order is an offer to purchase. An automated order confirmation only acknowledges receipt and does not mean the order has been accepted. We may verify payment, inventory, shipping information, quantity, compatibility concerns, or suspected fraud before accepting an order. Acceptance occurs when we confirm fulfillment or ship the order.
We may limit quantities or cancel an order for legitimate reasons, including inventory errors, pricing errors, payment failure, suspected fraud, shipping restrictions, or inability to fulfill the order. If we cancel after payment, we will refund the affected amount to the original payment method.
5. Prices, Promotions, Taxes, and Payment
Prices are shown in U.S. dollars and may change before an order is submitted. Promotions, coupons, and discounts are subject to their stated limits and may not be combined unless expressly allowed. We may correct typographical, pricing, or promotional errors. If a correction materially changes a submitted order, we will contact you before fulfillment or cancel and refund the affected item.
You authorize us and our payment providers to charge the payment method selected at checkout for the order total, including applicable shipping and taxes. You represent that the payment and billing information you provide is accurate and that you are authorized to use the payment method.
6. Shipping and Delivery
We currently accept online orders for delivery within the United States where checkout is available. Shipping charges and available delivery methods are shown at checkout. Delivery dates are estimates unless expressly stated as guaranteed.
You are responsible for providing a complete, accurate, and deliverable address. Additional charges caused by an incorrect address, refused delivery, or unauthorized rerouting may be deducted from a refund where permitted by law.
If we cannot ship within the time stated or otherwise required by law, we will seek your agreement to a revised shipment date or cancel the affected merchandise and provide a full, prompt refund. We will not substitute a materially different product without your approval.
A delivery is generally complete when the carrier records delivery at the address provided. If tracking shows delivery but the package is missing, or if the package arrives damaged, contact us promptly. We will work with you and the carrier to investigate and determine the appropriate resolution under the circumstances and applicable law.
7. Returns, Refunds, and Cancellations
Returns, refunds, exchanges, damaged shipments, and order cancellations are governed by our Refund Policy, which is incorporated into these Terms. Nothing in these Terms limits a right or remedy that cannot legally be limited.
8. Installation, Programming, Monitoring, and Third-Party Services
Some products require professional installation, configuration, programming, a compatible control panel or recorder, a broadband or cellular connection, a manufacturer account, or a paid third-party subscription. These requirements are not included merely because the product can support them.
Third-party apps, cloud platforms, cellular services, voice assistants, monitoring providers, and manufacturer services are controlled by their respective providers and are subject to separate terms, fees, privacy practices, availability, and technical requirements. We are not responsible for a third party’s independent service changes, outages, discontinued support, or account decisions, except to the extent required by law or expressly agreed by us in writing.
9. Security Equipment Limitations and Responsible Use
Security and life-safety products can reduce risk and improve awareness, but no camera, alarm, lock, sensor, recorder, or connected service can prevent or detect every event or guarantee police, fire, medical, or other emergency response. Equipment may be affected by placement, installation, maintenance, power loss, depleted batteries, network or cellular outages, interference, environmental conditions, user settings, or third-party service availability. Security equipment is not insurance and is not a substitute for appropriate insurance, emergency planning, or reasonable safety practices.
You are responsible for proper installation, lawful placement and use, periodic testing, maintenance, software and firmware updates, secure passwords, account access, and replacement of batteries or other consumable parts. Do not use the Website or a consumer device to report an emergency; contact the appropriate emergency service directly.
You are also responsible for complying with laws and rules governing video or audio recording, privacy, notices, consent, access control, permits, alarm registration, and use at homes, rental properties, workplaces, or public-facing locations.
10. Product Warranties
Any written product warranty is the warranty identified in the product listing, packaging, documentation, or manufacturer’s published terms. Warranty coverage and procedures vary by product and manufacturer. Except for an express written commitment from EcoSmart Security, we do not create an additional product warranty beyond rights that apply under law. Nothing in these Terms excludes warranties or consumer remedies that cannot lawfully be excluded.
11. Accounts and Website Use
You are responsible for keeping your account credentials confidential and for activity conducted through your account. Notify us promptly if you believe an account has been accessed without authorization.
You may use the Website only for lawful purposes. You may not interfere with the Website’s operation or security, attempt unauthorized access, introduce malicious code, scrape or harvest data through automated means without permission, impersonate another person, submit fraudulent orders, or use Website content in a way that infringes another party’s rights.
12. Intellectual Property
The Website and its original text, graphics, design, logos, software, and other content are owned by EcoSmart Security or used with permission and are protected by applicable intellectual-property laws. Product names, logos, photographs, and documentation may belong to their respective manufacturers. You may view and use the Website for personal or internal business purchasing purposes, but you may not reproduce, distribute, modify, or commercially exploit Website content without permission.
13. Website Availability and Disclaimers
We may update, suspend, or discontinue parts of the Website for maintenance, security, legal, or business reasons. To the fullest extent permitted by law, the Website is provided on an “as available” basis. We do not promise that every feature will be uninterrupted or error-free.
Product-specific warranties and non-waivable legal rights remain in effect. Other than those rights and any express written promise we make, we disclaim implied warranties to the extent the law permits.
14. Limitation of Liability
To the fullest extent permitted by law, EcoSmart Security will not be liable for indirect, incidental, special, exemplary, or consequential damages, including loss of data, recordings, business, profits, use, or anticipated savings, arising from the Website, a product, or a third-party service.
To the fullest extent permitted by law, our total liability arising from a product order will not exceed the amount you paid us for the product giving rise to the claim. These limits do not apply to fraud, willful misconduct, gross negligence, personal injury caused by negligence where liability cannot be limited, or any other liability or consumer remedy that cannot legally be excluded or limited.
15. Events Beyond Reasonable Control
We are not responsible for delay or failure caused by events outside our reasonable control, such as severe weather, natural disasters, carrier disruptions, labor disputes, government actions, utility or network failures, cyberattacks, supplier shortages, or similar events. This section does not change your right to cancel or receive a refund when required by applicable law.
16. Privacy
Our Privacy Policy explains how personal information is collected and used. Third-party payment, financing, app, monitoring, and cloud-service providers may apply their own privacy policies.
17. Changes to These Terms
We may update these Terms from time to time by posting a revised version and changing the “Last updated” date. Changes apply prospectively. The terms in effect when you submit an order govern that order unless a change is required by law or you agree otherwise.
18. Severability and No Waiver
If any provision of these Terms is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision once is not a waiver of the right to enforce it later.
19. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Subject to any non-waivable consumer rights, disputes relating to these Terms or an order may be brought in the state or federal courts serving Harris County, Texas. Nothing here prevents either party from seeking relief in a court with lawful jurisdiction.
